Terms of Business
  1. 1. Applies to

    These terms and conditions apply to the Overseas Mortgage Professional websites, and all business transacted to Overseas Mortgage Professional as a result of using the website.

    2. Regulatory status

    Overseas Mortgage Pro carries out no activities regulated by the Financial Services Authority and is not authorised to carry out such activity. We are, however, a UK based licensed credit brokers, reference number 457478.

    3. Disclaimer of liability


    Although Overseas Mortgage Professional strives to provide our members with current, complete and accurate information, the quality of the information provided cannot be guaranteed. We therefore do not accept any liability for any out of date, inaccurate or incomplete information shown on the Overseas Mortgage Professional system, nor do we accept any responsibility for:

      • The general compliance or advice provided by members to their clients.
      • The content of advertising material or promotions, including, without limitation, any error, omission or inaccuracy.
      • Mortgage providers or introductory affiliates.
      • The decline of mortgage applications.
      • Any direct or indirect consequential loss of profit revenue or business which may result by using the mortgage sourcing system.


    We cannot warrant that:

      • The provision of the mortgage sourcing system will be uninterrupted or error free.

    4. Accessing external websites

    The Overseas Mortgage Professional system accessible via www.overseasmortgageprofessional.co.uk or www.overseasmortgageprofessional.com may contain web links to affiliate companies so to provide our members and their client(s) with service options that compliment the Overseas Mortgage Professional proposition. Although we believe these service providers to be reputable, their websites are not under our control and we are therefore not responsible in any way for their content.
    5. Subscription period

    Once you have registered with Overseas Mortgage Professional, the subscription period will last for 12 months. Your subscription will automatically be renewed on a annual basis every year there after.

    Should you wish to cancel your subscription at any stage please familiarise yourself with our Cancelation and Refund policy as set out within section eleven of the Terms of Business.

    6. Our rights

      • To alter or withdraw in part or in whole any service available on the Overseas Mortgage Professional system, without being liable for loss or damage however caused.
      • To seek legal and financial redress from any party who deliberately attempts to damage or sabotage the Overseas Mortgage Professional system.
      • To seek financial redress from any party who does not abide by these terms and conditions, when we feel it is appropriate to do so.

    7. Complaints Procedure

    At Overseas Mortgage Professional we strive to provide you with a high level of service. If however you do have a complaint please write to us at Customer Service Team, Overseas Mortgage Professional, 2nd Floor Stirling House, 21-25 Station Lane, Hornchurch, Essex, RM12 6JL. So that we can make a thorough investigation please ensure your correspondence includes a full complaint description, and contact details so we can direct our response.

    8. Data Protection
    We will store and use any personal information about you to fulfill your instructions in accordance with the Data Protection Act 1998 ("The Act"). This information my be made available to certain third parties such as regulatory authorities, our auditors or mortgage lenders, who may also be bound by the Act.

    As part of our proposition we may need to use "cookies" to store and track information about your use of Overseas Mortgage Professional.
    9. Access to personal data

    Under the Data Protection Act 1998 we are entitled to charge an administration fee of £10 for allowing you access to your personal data. All requests for copies of personal information should be made in writing to accompanied by the administration charge to Overseas Mortgage Professional, Second Floor, Stirling House, 21 - 25 Station Lane, Hornchurch, Essex RM12 6JL.

    10. Application Service

    We require all system members and their client(s) to understand and agree to the following requirements prior to applying for the Overseas Mortgage Pro Application service.

    PLEASE NOTE: Our agreement is with our members and not their client(s), it is therefore the member’s responsibility to ensure the following requirements are understood, agreed to, and met by their client(s). We encourage all members to cover themselves legally and financially in the event of cases not proceeding, please refer to our Cancelation & Refund policy in section 11 for more details.

    I the member understand and agree that:

      • Overseas Mortgage Professional can only provide advice based on the information that has been provided to them.
      • Overseas Mortgage Professional cannot be held responsible should a mortgage lender not be able to provide a mortgage offer within the timescales that client(s) may have committed to for their purchase.
      • Overseas Mortgage Professional expects client’s to personally complete all the relevant application forms, or ensure they have read and checked the information to confirm its completion and accuracy in the event of the forms being completed by another party.
      • The information provided on the application forms will be used by the mortgage lender to form a lending decision.
      • Should a client’s circumstances change during the application process in such a manner that would contradict the accuracy of the information supplied, notification of the change in circumstance will be given by the client(s) to the mortgage provider in writing.
      • As part of the underwriting process the mortgage provider and Overseas Mortgage Professional may need to contact third party institutions such as current or previous employers, mortgage lenders, accountants, banks, and the Inland Revenue so to confirm the truth, completeness and accuracy of the information provided by clients in their mortgage application. All clients therefore agree to permit each of the parties aforementioned to carryout such enquires.
      • A credit reference for each client(s) may be required by the mortgage provider so to comply with their underwriting process.
      • Overseas Mortgage Professional strongly advises the client(s) to take independent legal advice.
      • To provide additional information should it be requested by the mortgage lender prior to completion of the mortgage.
      • Once a mortgage is in place, failure to maintain mortgage payments may result in the repossession and forced sale of the property.
      • The mortgage lender has the right to revise or retract any formal offer of lending prior to completion without reason.
      • Clients are liable for all costs incurred relating to the mortgage application even if the mortgage does not complete. We recommend the system member makes their own provisions to ensure they are covered financially in every eventuality.
      • To the Overseas Mortgage Professional Cancelation & Refund policy (detailed below).
      • Any introductory procuration payments will be made in sterling (GBP) and it is the member who is responsible for any costs involved should they require conversion to other currencies.
      • As Overseas Mortgage Professional is not VAT registered, we do not add VAT to any procuration fees received by us.  Therefore any commission paid by Overseas Mortgage Professional should be seen as being inclusive of any VAT liability, as we will not stand liable for any VAT that may occur.
      • To the fee structure of the Overseas Mortgage Professional application services which are offered.
      • Overseas Mortgage Professional will not accept any liability should a procuration fee not be paid by a mortgage provider.
      • To the mortgage lender disclosing details of the progress of the client’s application to Overseas Mortgage Professional.
      • That any introductory third party cannot be held responsible for any part of the Overseas Mortgage Professional service or any commission payment issues that may arise.

    11. Cancelation & Refund Policy

    Should you decide to cancel your Overseas Mortgage Professional membership please do so in writing to Overseas Mortgage Professional, Second Floor, Stirling House, 21 - 25 Station Lane, Hornchurch, Essex RM12 6JL, or by telephone on 01708 676121.

    Please note once you have joined Overseas Mortgage Professional you will not be entitled to a part refund of your initial 12 month subscription payment or any renewal 12 month subscription payment that has been made to access the service for the 12 month period.

    Should a mortgage lender decline your client’s application, we will endeavour where possible to find an alternative source of funding. If your client has disclosed all relevant information to us and the mortgage provider subsequently declines the application and we are unable to find your client an alternative source of funding, we will refund the service fee less a sum of £195 for our administration costs. Should the application be declined by the lender due to information that has not been disclosed to us, or the client decides not to proceed with the application, the service fee will NOT be refunded, but may be transferred to an alternative mortgage application.

    In event that we have paid a member a commission that later needs to be refunded to the client, the OMP member will be required to immediately repay the full amount of commission received, upon written instruction from Overseas Mortgage Professional. We strongly recommend that Overseas Mortgage Professional system members fully cover themselves from any financial loss that may result as consequence of their clients' actions.

    13. Commission Payments
    In exchange for providing a fully completed pre application form, a signed terms of business by the client, our service fee and managing the relationship with the client we will pay our members a commission share of 40% of all case fees. Should a member not provide all of the above components a reduced commission of 25% of all case fees will be paid. All commission payments will be made at regular intervals at the discretion of OMP.

    All rights reserved. The content of these web pages are owned and controlled by The Connect Finance Group Ltd. Any unauthorised copying, selling or distribution will constitute an infringement of copyright, unless consent in writing has been granted by an authorised signatory from The Connect Finance Group Ltd.

    15. Updates/Amendments to these conditions

    These terms and conditions may be updated by us from time to time without notice to you. You should review the terms and conditions displayed on the Overseas Mortgage Professional website periodically for any changes.
